Anger at smiling child killer walking free from Australian court

Tyrell Cobb's stepfather Matthew Ian Scown has been sentenced to four years in prison for the 2009 manslaughter on the Gold Coast of his four-year-old stepson Tyrell Cobb, who died from a blunt force trauma injury to his abdomen.

There was no doubt Scown was delighted.

Tyrell Cobb was found unconscious and later died in hospital in 2009.

In extraordinary scenes, the 34-year-old smiled for the cameras and laughed to himself as he walked away from court through a media scrum.

"They're doing all these plea bargains just to move cases through".

"There's not a day goes by that he (Scown) doesn't think of Tyrell", Mr Allen said.

"[There was] ... a total of 53 bruises and 17 abrasions".

Heidi Strbak will face a manslaughter trial next month.

She said offenders are "laughing" after a series of cases in which child killers have had charges reduced, including a man who tortured his infant daughter to death.

Committal hearings are held to see if there is sufficient evidence for a case to advance to trial.

Scown is the former de facto partner of Tyrell's mother, Heidi Strbak, who is also charged with manslaughter.

Scown was not accused of causing the fatal injury to Tyrell, but of standing back and watching the tiny boy die as his condition got worse.

Scown called Triple-0 in distress and performed CPR on the boy as paramedics made their way to the Gold Coast home where the pair were staying.

Prosecutor Phil McCarthy said Scown told the operator "it looks like he's going to die".

When handing Scown his sentence, Justice Martin Burns said Tyrell would have been "in extreme pain" and "very, very ill" when he died.

Mr McCarthy said the mother, instead, went with her brother to get cigarettes, leaving Scown to care for Tyrell.

The elderly woman sobbed loudly as her son's four-year jail term was immediately suspended because Scown had spent nearly three years on remand.

Queensland Premier Annastacia Palaszczuk said the reaction of Scown upon his release yesterday was "completely insensitive".

'From the time of injury until death every movement including breathing and vomiting would have caused extreme pain'.

Caught smirking outside court on Wednesday, Mr Scown's family has told Seven News the reason he laughed was because a cameraman had fallen over, and they feel he has been unfairly depicted as a callous monster. "So if you know it's happening and you haven't done anything to stop it, you're as guilty as the perpetrator", Hetty Johnson from Bravehearts said.

'Your failure to obtain medical assistance for him renders you criminally negligent for his death'.
