Court defeat means Jacob Zuma is running out of road

The High Court in Pretoria ruled earlier this year that the 2009 decision to withdraw charges was irrational and set it aside which had the automatic effect of the charges being reinstated against the president.

South Africa's Supreme Court of Appeal ruled on Friday that President Jacob Zuma can face prosecution over nearly 800 charges of corruption relating to a 1990s arms deal.

On Friday, Judge Eric Leach read an excerpt of the SCA judgment, written by Judge Mahomed Navsa.

Kemp said that if the SCA finds that Mpshe did not make a rational decision, then someone would have to make a rational decision on that basis.

The NPA argued that determining the date for the serving of an indictment on Zuma was politically motivated.

The Supreme Court of Appeal has rejected, with costs, President Jacob Zuma's appeal in his long running battle to avoid prosecution for fraud and corruption.

Justice Leach, who only took eight minutes to hand down his ruling, said that the manner in which the case was conducted on behalf of the NPA was inexcusable. He also conceded that a decision to withdraw charges that was based exclusively on the timing of the indictment was irrational.

He said the picture that emerged was one in which Deputy National Director of Public Prosecutions Willie Hofmeyr and Mpshe were "straining to find justification" for discontinuing the prosecution. Last month, Zuma's legal counsel admitted the decision to withdraw the charges was irrational.
