Ndume will resume tomorrow - Senate

Former majority leader of the upper legislative chamber, Senator Ali Ndume, who was controversially suspended about eight months ago, has been recalled by the Senate.

Deputy President of the Senate, Ike Ekweremadu, who presided over the plenary on Tuesday, made the announcement after an executive (closed-door) session.

Senate had said it will file an appeal on November 13 against judgment of the Federal High Court ordering it to pay all salaries and allowances of Sen.

A Federal High Court last week, ordered Ndume's immediate reinstatement and payment of all his entitlements for the period of the suspension.

The senator, representing Borno State (APC), was placed on suspension following the recommendation of the ethics and privileges committee of the Senate headed by Chris Anyanwu.

Mr. Ndume was subsequently suspended for six months for "bringing Melaye, his colleague, and the institution of the senate to unbearable disrepute" after the Senate adopted the report by the committee.

The Borno senator‎ had asked the senate to investigate the allegation that the red chamber was exacting vengeance on Hameed Ali, comptroller-general of the Nigeria Customs Service, because of a seized bullet-proof vehicle allegedly owned by Saraki.

"Besides, Senate spokesman, Senator Abdullahi Sabi Aliyu had earlier advised Ndume to withdraw his suit against the senate last September otherwise the upper chamber would contest decisions of the courts to the Supreme Court of Nigeria".

"The court has so declared that it was not right and it was illegal".

"That by the provisions of sections 3 and 30 of the Legislative Houses (Powers and Privileges) Act, " he said the trial court lacked requisite jurisdiction to hear the suit of the Plaintiff.

The senate also argued that the trial judge erred by holding that the respondent can join several causes of action in one suit among other grounds and arguments.

However, the Senate through its counsel, Mike Ozekhome, said on Sunday that it would appeal the ruling.

"An application for a stay of execution of the orders of the court will also be filed same time".
