Jeff Sessions Flip-Flops, Says Obama-Era Marijuana Policies Are Still in Effect

The suit against the attorney general as well as the Department of Justice and the Drug Enforcement Agency was filed in the Southern District of NY by Alexis Bortell, along with her father and other plaintiffs, including former National Football League player Marvin Washington, according to a report by ABC News.

A 12-year-old girl, who uses medical marijuana to manage her epilepsy and resultant seizures, is suing U.S. Attorney General Jeff Sessions to legalize the drug nationwide.

Bortell has been suffering with seizures since she was 7-years-old.

[The government] made a representation that cannabis has medical application for the treatments of Parkinson's Disease, HIV-induced dementia and Alzheimer's disease, and yet at the same time, the United States government maintains that there is absolutely no medical benefit for the use of cannabis.

The lawsuit hopes to help give all Americans the right to legal and medical marijuana. That's why she's aiming to prove the U.S. Controlled Substances Act unconstitutional as it relates to marijuana with her lawsuit against Sessions.

The suit claims that Alexis can not return to her home in Texas to attend college because she would be subject to arrest if she continued to use marijuana to control her seizures.

"She just wants to be like everybody else", Alexis's father, Dean Bortell, told NBC News.

In Bortell's case, she can not travel without cannabis oil-a treatment she has opted for over brain surgery-and that limits her ability to visit her grandparents' home state of Texas (where medical marijuana is illegal) or to go onto military bases with her veteran parents, reports NBC News. She wants to be treated like an American citizen and not just a state citizen. She would have to choose between living a normal life and going to get higher education for a better future. It has kept her seizure-free for 2.5 years.

National restrictions on marijuana use have always been stupid and hypocritical.

That's the reason why the teen and her parents have joined four other plaintiffs in a lawsuit that aims to legalise medical marijuana at the federal level.

At issue is that while 29 states and three US territories have cleared marijuana for medical use, the federal government still classifies it as a Schedule I drug under the CSA.

Reclassifying marijuana would make it easier for researchers to work with the plant, which could result in the discovery of more life-saving drugs like the one that Bortell (and thousands of other children) rely on.
