Jury chosen in trial of man charged in girl's slaying

Seeing that something was amiss and fearing that the man might harm her daughter, Rayne called the authorities and told that Smith abducted her daughter. She was looking for clothes for all three children and could not afford the purchases. He offered to take them to a nearby Walmart, where he had a gift card he wanted to let them use for clothes.

The mother of a young girl who was abducted by a man posing as a good Samaritan in 2013 sobbed in court as she faced her daughter's accused killer.

"He looked into my face and told me I was safe", she said on the stand Monday.

In his closing argument, prosecutor Mark Caliel said Cherish 'endured a nightmare no child should have to endure'. "This is all about the death penalty portion of the case from a mitigation standpoint, and that might be one reason why (he thought it was) a bad idea to cross-examine Rayne Perrywinkle".

The mother and her three daughters piled into Smith's white van. They went to a nearby Walmart and she began shopping with her girls, placing three small piles of clothing in a shopping cart.

It got late, after 10 p.m., and Smith's wife never appeared.

Cooper made it clear that his attorneys would not get another chance to question Perrywinkle, but Smith said he didn't want to put her through it. Smith said he would go to the McDonald's inside the store and pick up a few cheeseburgers. Employees of both the Dollar General where Smith met the family and the Walmart where Cherish was last seen alive verified surveillance footage for the panel, while a formerly married couple described an odd exchange they experienced with Smith in the Walmart parking lot.

Cherish's body was covered in severe injuries, abrasions and contusions and she was strangled, tortured and raped. Her cellphone didn't work - a daughter had dunked it water to try and clean it - so she cried out for help realizing her daughter had been taken.

"I was yelling, 'Call 911". "I hope to God he doesn't kill her and I hope to God he doesn't rape her", she told the dispatcher. Perrywinkle's mother called 911 after she suspected Smith had left with the girl.

Also on Tuesday, State Attorney Melissa Nelson played for the jury secret recordings that were done in jail, and on which she said Smith could be heard bragging about his crime. He gagged her with such force, her gums and nostrils bled. She was wearing an orange dress with a fruit pattern on it.

Nelson said that when Smith was arrested, he was wet from the waist down.

Perrywinkle's mother, Rayne Perrywinkle, testified in court today.

Smith, who has a criminal record dating back to the 1970s, is represented by public defenders. He was deemed a violent sexual predator after an arrest in 1999, and was ordered to get treatment after serving a prison sentence.
