Judge releases video of fatal federal courtroom shooting

The video then shows a deputy US Marshall identified in court documents as Jane Doe pull her gun from its holster and fire four quick shots at Angilau

The footage shows the moment the defendant, Siale Angilau, a member of the Tongan Crips gang, getting up out of his seat, grabbing a pen, and running towards the witness stand before launching at him.

The witness jumps out of the way and after various commands, including, "drop the pen" and "get on the ground", "Deputy Jane Doe", a U.S. Marshal, fired four shots, killing Angilau.

Dowdell's rulings represented mixed results for the U.S. Department of Justice and the Angilau family.

Angilau's family wanted a jury to see the video to see if the marshal used appropriate force after the Federal Bureau of Investigation found the shooting was justified. He points out that Angilau was already down on the ground for the final three shots and that a courtroom full of officers could have stopped him before he harmed anyone with the pen.

The 24-second video recording shows Angilau charging towards a witness with a pen in hand.

The man jumped back to avoid being hit as Angilau fell feet-first over the front of the witness stand and the unidentified U.S. marshal fires his gun.

"Angilau was in custody, but he essentially had escaped custodial control for those seconds during which he was executing his plan to assault the witness", the judge wrote in a ruling obtained by Deseret News. "His attack was stopped by the shots that Jane Doe rapidly fired, in less than one and one-half seconds". Faces of the judge, attorneys and jurors are blurred out.

The Angilau family attorney, Bob Sykes, said Monday morning he had not yet had an opportunity to discuss an appeal with his clients but hoped to do so "shortly".

'There was no necessity to use force'.

But he said the family is glad the video has been made public - and that they want justice. A wrongful death lawsuit by Angilau's family was dismissed on the same day. Dowdell sided with Cleary's order Friday.

They were allowed to view the video but not release it.

Angilau was one of 17 Tongan Crip members named in a 2010 indictment accused of assault, conspiracy, robbery and weapons offenses.

He was the last defendant in the case to stand trial, with previous defendants being sentenced to 10 to 30 years in prison.

Before he died, the incident prompted US District Judge Tena Campbell, who was hearing the case, to declare a mistrial.

The news outlets that pursued release of the video include The Salt Lake Tribune, print and broadcast outlets from Salt Lake City, the Utah Headliners Chapter of the Society of Professional Journalists and The Associated Press.
