SC extends Aadhaar linking deadline for all services till constitution bench's verdict

Bringing temporary relief to Indian residents, the Supreme Court on Tuesday announced that the deadline for linking mobile numbers and bank accounts has been extended till the top court decides delivers its judgment on a batch of petitions challenging the constitutional validity of Aadhaar.

In an interim order, the court has said that the government can not insist on mandatory Aadhaar linkages - unless it is for the express objective of subsidies - until the bench finally decides one way or the other.

The apex court is now in the process of hearing a clutch of petitions that challenge the validity of the Aadhaar scheme. The Supreme Court also noted that the Aadhaar Card would only be necessary for social welfare schemes and not other consumer services such as a getting a mobile phone connection.

However, it is still mandatory to link your welfare schemes with Aadhaar to get benefits under Article 7 before the deadline.

However, the deadline for subsidies and government programs remains March 31.

The order was passed by the Constitution Bench of Chief Justice Dipak Misra and Justices AK Sikri, AM Khanwilkar, DY Chandrachud and Ashok Bhushan. His arguments revolved around the introduction of the Aadhaar Bill as a Money Bill.

It was submitted that the Rajya Sabha has an important role to play, and by introducing the Bill as a Money Bill, its role was bypassed.

"The government can not insist for mandatory Aadhaar even for issuance of Tatkal passport".

The court made it clear that the extension of the time limit beyond March 31, 2018 shall apply for Aadhar linkage, besides the schemes of the Ministries/ Departments of the Union government and all state governments in similar terms.

The matter will be heard again tomorrow.
