Parents of Alfie Evans Launch Fresh Legal Challenge to Keep Son Alive

The parents of a 23-month-old boy at the centre of a life-support treatment battle have lost their latest legal battle to have their child treated overseas.

Judges have heard how Alfie, born in May 2016, is in a "semi-vegetative state" and has a degenerative neurological condition that doctors have been unable to diagnose definitively.

Court of Appeal judges have rejected an bid by the parents of terminally ill toddler Alfie Evans to overturn a decision over who has control of his life support. "They should forfeit ability to dictate Alfie's best interests.not terminate his life due to their failures to diagnose him and treat him effectively".

Alfie Evans' parents, who live in Liverpool, are using a piece of ancient English common law during the latest stage of their fight for treatment.

However, Alder Hey said in a statement: "Noise from recent protests has unfortunately affected our patients so we would ask that noise levels outside the hospital are kept to a minimum and, for example, auto horns are not sounded".

Last month, Mr Justice Hayden had ruled that it was in Alfie's best interests for his treatment to be withdrawn.

They are now arguing that Alfie is being wrongly "detained" at Alder Hey and have made a habeas corpus application.

Last week, Mr Justice Hayden endorsed a detailed plan put forward by Alder Hey doctors for withdrawing life-support treatment, after considering a number of issues at a follow-up High Court hearing.

The letter, from the Liverpool hospital's chief nurse, said the only Alfie's parents and two named visitors were now allowed to visit the Peadiatric Intensive Care Unit (PICO) at one time.

The force also urged people to consider other hospital users at Alder Hey, adding the emotional scenes outside the children's hospital caused "significant traffic disruption and inconvenience" to others.

Moylan denied the parents permission to file an appeal to his decision to the U.K. Supreme Court, saying that the parents' wishes were already well established and that they could not perpetuate a "legal Groundhog Day" by continuing to appeal decisions with the same argument. Diamond indicated that he would make a direct appeal to the Supreme Court by 4 p.m. local time on Tuesday.

He then alleged the hospital called the police to prevent him removing his son, with officers allegedly telling him he would be "arrested for assault" if he attempted to remove Alfie.

The court ruled that his life support won't be turned off until the Supreme Court has reached its decision. The protests have allegedly caused road blockages and prevented some staff from entering the hospital.

He said medical experts' unanimous view was that Alfie's brain had been eroded by disease and further assessment was pointless.
