Prosecutor says Meek Mill's case should be thrown out

Add the Philadelphia District Attorney's Office to those in favor of rapper Meek Mill getting a new trial.

Lawyers for rapper Meek Mill, real name Robert Williams, celebrated on Monday a Philly judge's decision to allow him a new trial, although he will remain in custody for now. Although the prosecutors say Meek Mill's drug conviction should be overturned, the controversial judge in the case, Deniece Brinkley, refuses to do.

Mill was sentenced two to four years in prison last November for violating his probation on grounds of failing a drug test and violating a court order limiting his travel.

Brinkley - did not dismiss Mill's charges during Monday's hearing. Mill's attorneys will "immediately" file for his release with a higher court, McMonagle said.

The D.A.'s office, which think Meek should be granted bail, told TMZ, it thinks the conviction should be tossed "due to serious issues regarding the credibility of the arresting officer in the case, Officer Reginald Graham".

TMZ reported that if the Philadelphia District Attorney office's wishes are granted, Mill's 2008 conviction would be thrown out. In February, Meek's lawyers questioned the credibility of a police officer involved in the 2007. DA also stated in open court that the prior DA was aware that Officer Graham was untrustworthy as far back as 2005, which was never disclosed to Meek's defense team.

A police spokesman said the department had no comment on the arresting officer allegations. The group indicated that Judge Brinkley allegedly requested to re-record Boyz II Men's "On Bended Knee" and demanded that Mill should switch his management team. They have unsuccessfully appealed the sentence multiple times and have called for Brinkley to recuse herself.
