Some members of Windrush generation have been wrongly deported, immigration minister admits

Theresa May will discuss children of Windrush with Commonwealth leaders in Government climbdown

Most of them, so called after the name of one of the first ships that arrived from Jamaica in 1948, are citizens of the United Kingdom and colonies, a type of citizenship conferred by the British Nationality Act of 1948.

But, despite having lived in the country for the majority of their lives, the group of British residents have begun to experience issues as a result of tightened United Kingdom immigration requirements.

Their problems include difficulties when finding work, getting NHS care, accessing benefits, or trying to secure housing.

But who are the Windrush generation and why are they facing deportation?

"What clearly needs to happen is we need to do a better job with the process that these individuals are having to go through".

"We want people to have confidence to come to the Home Office, we want to give them a message of reassurance, because we value these people".

Ms Nokes apologised to members of the Windrush generation, saying: "I am very sorry that this situation has arisen".

She urged anyone who is unsure about their immigration status to apply for a card to confirm their status from the Home Office, which was "currently establishing a dedicated contact point for people with questions and applications".

Who are the Windrush generation?

The problem follows the ending of a previous system of Commonwealth citizenship and free movement, when status was conferred by law on people to safeguard them but some did not acquire the necessary papers, according to immigration law blog Free Movement.

But the home secretary said she would investigate to see if any had been as suggested by her junior minister.

"Theresa May must apologise for this mess which has taken place as a direct outcome of the hostile environment she created".

"The Windrush generation must have their rights as British citizens confirmed, any who have been deported must be invited back to the United Kingdom immediately and those who oversaw their deportations must be held to account".

An online petition calling for an amnesty for those who arrived in Britain from Commonwealth countries in the Caribbean as children, and a lowering of the level of documentary proof required from people who have lived here since they were children, has now attracted more than 136,000 signatures.

Theresa May has announced she would meet Caribbean state leaders this week.

The Home Office earlier confirmed the meeting was requested but the subject of the proposed meeting was not made clear.

May only became aware of a request for a meeting on Monday morning, and will discuss the issue with counterparts from Caribbean nations this week, her spokesman said.

However, the Home Office did not keep a record of those granted leave to remain or issue any paperwork confirming it, meaning it is hard for the individuals to now prove they are in the United Kingdom legally.

"We are not aware of any specific cases of a person being removed from the United Kingdom in these circumstances and we have absolutely no intention of asking anyone to leave who has the right to remain here".

The Downing Street U-turn came after 140 MPs from across the parties wrote to the Prime Minister calling for an "immediate and effective" response to the concerns of Windrush generation residents.
