At the resumed hearing of a joint ad hoc committee of the senate and house of representatives, on Tuesday, the committee chairman, Bala Na'Allah, said the two lawmakers were invited based on the indicting testimonies.

The incident which occurred while plenary was ongoing in the chambers was linked to Omo-Agege, who defied the suspension order on him and attended the proceedings, accompanied by some odd fellows into the chamber.

"As an institution that obeys the law and court orders, the Senate has decided that it will comply with the judgement of the Federal High Court and do nothing to stop Senator Ovie Omo-Agege from resuming in his office and at plenary from tomorrow May 15, 2018, pending the determination of the application for stay of execution". At this time, Omo-Agege was not anywhere around the chamber.

For Senator Omo-Agege, the Committee in the invitation letter said, "based on the testimony of the National Assembly Divisional Police Officer (DPO), the DSS and the Sergeant at Arms, you are alleged to have entered the National Assembly accompanied by seven persons who allegedly took the mace of the Senate during plenary session on April 18, at about 11:30 a.m".

Justice Nnamdi Dimgba of the Abuja Division of the Federal High Court in a pronouncement last week Thursday said the Senate's decision regarding the suspension, as well as the pattern adopted by the National Assembly, was constitutionally defective.

Mr Omo-Agege had approached the court to determine whether the Senate has authority to investigate and even discipline a senator, whose case is already before a court of law.

The judge stated that the decision recommended by the committee to punish Omo-Agege for going to court was wrong and contravened Sections 4 and 6 of the constitution adding that he had a right to go to court. "While this suit was pending, and to the knowledge of the Senate and the Senate President, they went ahead and imposed a sanction on him".
