Are You Ready for GDPR?

Unless they band together and share a DPO, it may be hard for small businesses to find someone suitable to take on the role, because the individual must be independent of management.

The new regulation applies to companies that control or process personal data of European Union individuals-no matter where they are located.

Many U.S. businesses will be subject to the GDPR.

She believes there is a misconception in many organizations that data protection compliance is merely a security issue.

Financial Services - Financial organizations often maintain huge stockpiles of PII data on account holders. Specifically, the GDPR covers all "Personal Data", defined as "information relating to an identified or identifiable natural person who can be identified, directly or indirectly, in particular, by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person". But can the EU really enforce the new regulation against USA companies without any physical presence in the Union?

"For South African organisations, if the GDPR applies to you, consider how you can combine your GDPR and Protection of Personal Information Act compliance programmes, as numerous requirements are similar (although there are some differences)".

Similarly, as more health and credit records move into the digital realm and the Internet backbone, such records have also ended up being hoovered up by nefarious actors - from organized crime to unscrupulous companies to repressive governments, used for blackmail, character assassination, electoral fraud or outright theft.

The platform has always had a lower data retention period than Facebook, never holding on to information for more than two years.

Data security is the other part. Companies will need to put in place practices that demonstrate that their processing activities are compliant.

The company promises better user transparency thanks to an updated Privacy Policy that will make it easier for users to understand what kind of data is collecting.

An individual also has several other important privacy rights. Like any new regulatory obligation, the GDPR appears at first glance to be a constraint, particularly given the amount of sanctions foreseen in the event of a breach: up to 4% of the company's global turnover or Euro 20 million.

GDPR is set to become the standard benchmark for data protection, says law firm Michalsons. A company must notify data subjects if the breach is likely to result in a risk to their rights under Article 34.

Does the GDPR still apply to just personal data?

Others will run blogs which are clearly just related to their personal household activities - these will definitely be outside scope.

In the event a medical tourism agent shares personal data with a vendor such as a hotel, the vendor must provide a Data Processing Agreement (DPA) with the supplier confirming the vendor's compliance to the GDPR and dictating the purposes for which such data is to be processed.

Subject to certain conditions, you are entitled to have your personal data erased (also known as the "right to be forgotten"). The biggest losers will be advertisers and marketers, who will now need to rethink their business models when consumer data is no longer effectively free to them. Unlike its predecessor law (the 1995 European Data Protection Directive, implemented in the United Kingdom by the Data Protection Act 1998) GDPR specifically addresses the issue of social networking (given that social networking as a concept didn't exist in 1995, it's hardly surprising the earlier law doesn't mention it!).

Where our processing of your personal data is based on your consent you have the right to withdraw your consent at any time.

Data controllers and processors should brace for potentially large fines for non-compliance.
