Mike Russell demands United Kingdom 'respect' Scotland after MSPs vote against Brexit Bill

The Scottish Parliament voted by a margin of 93 to 30 not to grant a Legislative Consent Motion (LCM) to the keynote Brexit legislation following the First Minister's warnings that it would lead to a Westminster "power grab".

The Scottish parliament's approval is not legally necessary for the bill to become law, as Westminster can disregard Holyrood, but such a move would provoke the biggest political rift between the two institutions since devolution in 1999.

The United Kingdom's European Union withdrawal bill is being now debated in the country's parliament and is due for the final vote in the House of Commons in the coming weeks.

It follows the United Kingdom and Welsh governments reaching agreement on changes to the EU Withdrawal Bill after months of talks.

The UK government and Scottish Tories have so far refused to offer any further concessions after the Welsh government dropped its opposition to the bill and accepted the power-sharing plans on offer.

The prime minister briefed Conservative backbenchers on Monday about the two options her ministers are considering: a customs partnership which see Britain collecting tariffs on behalf of the EU; and a combination of technological and administrative measures created to diminish friction on a UK-EU customs border.

Scottish Government Brexit Minister Mike Russell said Mrs May's administration in Westminster had "no mandate" to "undermine the devolution settlement".

"Let's be clear: Labour and Liberal Democrat support would not amount to backing for the UK Conservative Government".

"We remain hopeful that the Scottish Government will still come on board".

Both governments agree those policies should operate uniformally across the United Kingdom, shared between the four governments in London, Edinburgh, Cardiff and Belfast.

Brexit means powers that have been exercised by Brussels returning to the UK.

"There will be different opinions as to whether we should do that now or in five years or ten years' time, but with that body of opinion, a constitutional option like independence is not going to be off the table", she said.

A source close to the negotiations said: "It's incredible that the Scottish government are now giving the impression that there was never any prospect of them signing up to a deal of this sort and that it's a constitutional outrage". The UK says it will consult the Scottish government on all changes to those policies, and try to seek agreement.

It is convention that AMs in Cardiff, and MSPs in Scotland, vote to give or refuse consent on Westminster legislation when it impacts devolution.

Labour MSPs joined the SNP and the Greens in opposing the bill. He said the government would press ahead with the Bill but suggested it would be open to amending it to reflect Scottish concerns. However even if Holyrood votes to refuse consent, Westminster can still go ahead and introduce the legislation anyway.
