Michael Flynn 'eager' for sentencing in lying case, attorney says

Judge again delays sentencing for Michael Flynn Trump's former national security advisor

The lobbyists, Nicolas Muzin and Joey Allaham, had given a statement to the Journal about the new firm, Stonington Global LLC, that included a comment attributed to Flynn saying he was excited to join it as director of global strategy. "He (Flynn) was aware that a statement was being drafted, but he did not intend that it be issued at this time".

Facing potentially severe charges that included acting as an unregistered lobbyist, Flynn agreed on December 1, 2017 to plead guilty to a single count of lying to investigators in exchange for cooperating with Special Counsel Robert Mueller's probe into possible links between the Trump campaign and Russian Federation. In the seven months since Flynn agreed to be a cooperating witness in Mueller's investigation into Russian meddling in the 2016 presidential election, his sentencing has been delayed three times.

According to Zoe Tillman of BuzzFeed, U.S. Federal Judge Emmitt Sullivan told Flynn that he could be sentenced as soon as late October.

In a joint reply to the judge, prosecutor Brandon Van Grack and Flynn attorney Robert Kelner had said that although they still wanted to postpone sentencing and could update Sullivan again about timing on August 24, they had asked to launch the pre-sentence investigation because it would eventually help the court schedule move more quickly.

Sullivan asked why he should break with his usual practice, which is to set a sentencing date at the same time he launches the pre-sentencing review. "Its issuance now in his name appears to have been the result of a misunderstanding", Flynn attorneys Robert Kelner and Stephen Anthony said in a statement to CNN.

On Tuesday Flynn appeared in a Washington court to discuss his sentencing, which has been repeatedly postponed by Mueller as he apparently continues to draw on Flynn's cooperation in the probe. While the delay in sentencing indicates that Flynn is still playing an active role in the special counsel's investigation, today's hearing did not provide insight about the nature of his role.

Flynn, who had been one of President Donald Trump's most vocal surrogates in his 2016 campaign, spent just over three weeks as national security adviser before fired for misleading Vice President Mike Pence about his contacts with Russian Federation.

Kelner said he did not expect material changes to the facts of the case going forward, an indication that evidence turned over by Mueller has not prompted a rethink of Flynn's plea agreement.

Flynn's mere presence in court in Washington could serve to puncture ongoing speculation by conservative media that Mueller's case against Flynn is falling apart and that the former national security adviser may withdraw his guilty plea.

It was not immediately clear from Tuesday's brief hearing before U.S. District Judge Emmet Sullivan what continuing obligation remained for Flynn before a sentencing hearing could be scheduled in the case.

Flynn stepped down as Trump's national security adviser in February 2017 and pleaded guilty in December. Paul Manafort, a former Trump election campaign chairman, faces charges that include conspiring to launder money and failing to register as a foreign agent in connection with his lobbying for the previously pro-Russia Ukrainian government, bank fraud and filing false tax returns. A few demonstrators chanting "lock him up" greeted Flynn outside of the courthouse.
