Supreme Court approves new BCCI constitution with modifications, relaxes Lodha reforms

The Supreme Court directed state cricket associations to adopt the BCCI constitution within 30 days

The apex court's three-judge bench, headed by Chief Justice of India Dipak Misra, had made the decision keeping in view the fact that cricket associates and former great players of many states have played historic roles which can not be left out.

Diluting the 'One State One Vote rule, the bench gave full membership to three associations each in Gujarat and Maharashtra.

The SC order implied that former president Anurag Thakur will also need to go for "cooling off" in case he gets relief from the apex court in near future and is able to come back into the BCCI fold. However, the cooling-off tenure of cumulative nine years (at BCCI or the state association) will apply.

On July 5, the apex court had restrained all the state cricket bodies from holding elections till it pronounced the verdict on finalisation of the draft constitution of the BCCI. Their membership was cancelled by the Supreme Court earlier on the recommendation of Lodha panel.

The Lodha panel had recommended a slew of structural reforms in BCCI which were approved by the apex court.

In the earlier hearing, the counsel for Tamil Nadu Cricket Association (TNCA) had opposed the cooling-off period for the office bearers suggested by the Lodha panel, and said there should be continuity of experience.

The Supreme Court on Thursday approved the BCCI constitution with modifications and rejected one state one vote recommendation made by the Lodha panel.

The age (70) and tenure caps (three terms of three years each) and the cooling off period (three years) between successive terms have been continuously objected by the BCCI and its state associations with several top administrators including N. Srinivasan, Niranjan Shah and Sharad Pawar standing disqualified from continuing in their posts.

While Amitabh was the president of Jharkhand State Cricket Association (JSCA) for more than a decade before becoming a BCCI office bearer, Aniruddh served as Haryana Cricket Association (HCA) secretary for six years before taking up the treasurer's position in the board. The Mudgal panel had gone into the state of affairs of the BCCI, following the 2013 IPL betting and spot-fixing controversy.
