Bethenny Frankel's Parenting Questioned by Ex-Husband after Overdose of Boyfriend

During a Thursday court hearing in the former couple's custody battle over 8-year-old daughter Bryn, Us Weekly reports Hoppy's lawyer Robert Wallack brought up Shields' death to Manhattan Supreme Court Justice Michael Katz.

Jason used the August 10 death of Bethenny's on-again, off-again boyfriend Dennis Shields as his go-to defense.

In court this week, Hoppy's lawyer added that Shields's involvement in Bryn's life paints Frankel as an inadequate parent since he spent "a great deal of time" with Bryn and often looked after her without Frankel's presence. "Very few people knew about the proposal", the friend said. The suit followed charges made against Hoppy for stalking and harassing Frankel.

"Considering Mr. Shields' addiction what does that say about Ms. Frankel's parenting that she would allow this person to care for her daughter?"

The New York City Office of the Chief Medical Examiner (OCME) said Friday in a statement it was investigating the death of a man who was "believed to be" Shields and that an investigation was ongoing. "This doesn't just constitute a lapse in judgment this was just downright risky parenting". Still, the judge scheduled a hearing for March to make a decision about custody of Bryn Hoppy.

"There was a recent episode in which she appeared to be intoxicated", Wallack told the judge.

Jason's lawyer said, "She was running around without clothes on and then she passed out and it was said she passed out from mixing Ambien with alcohol". He then said Bethenny may have "some type of substance-abuse problem" and requested the court to drug test her. She loved him. He's her family and her best friend and her confidante.

Frankel, dressed in black, was wearing a large diamond ring on her right finger.

Frankel's on-again, off-again boyfriend was found dead at his apartment in Trump Tower on August 10 after overdosing on Oxcodone, TMZ reported at the time.
