A ME lobster pound owner who is treating lobster with marijuana smoke before cooking them in hopes of killing them more humanely says she hopes to have a treatment system fully in place in "the next few weeks", despite concerns that have been raised by the state and an animal rights group. But the program doesn't comment on medical marijuana violations, so it would not confirm whether it was investigating Charlotte's Legendary Lobster Pound or Gill, spokesman David Heidrich said. Department of Health and Human Services spokesperson Emily Spencer told the New York Times that health inspectors "would treat food served to consumers at licensed eating places and affected by marijuana, as has been described with this establishment, as adulterated and therefore illegal".

Visitors to the restaurant can choose whether they want to have their lobster pre-calmed using marijuana or not.

Gill has been placing lobsters in a covered box with 2 inches of water at the bottom, then blowing cannabis smoke into the water in hopes of sedating the lobsters to make their upcoming deaths less traumatic.

"It's just an under-studied field, and maybe they play a role in other animals", he said.

"They're much simpler than insects", he said "They can't report". Lobsters experience the world in fundamentally different ways than humans do, he noted. There is increasing evidence that crustaceans can feel pain. Earlier this year, Switzerland passed a law that live lobsters must be stunned before they can be cooked live.

"It is highly unlikely that getting a lobster high would make a lick of difference when it comes to the full-blown agony of being boiled or steamed alive", PETA said in a statement to Marijuana Moment.

"The process is for the physical comfort of the lobster, not the consumer", Gill said on her Facebook page.
