Calif. judge dismisses Ashley Judd's sexual harassment lawsuit against Harvey Weinstein

Judd was one of the first women in 2017 to publicly accuse Weinstein of sexual misconduct

Weinstein's lawyers in July insisted Judd had struck a "deal" with Weinstein allowing him to touch her if she "won an Academy Award in one of his films".

At a Los Angeles federal court on Wednesday, Judge Philip Gutierrez said that Ashley's allegations against Weinstein, 66, did not fall within the California statute under which she had filed the lawsuit.

The rest of Judd's case, which includes claims of defamation, intentional interference with prospective economic advantage; and a violation of California's Unfair Competition Law, all for Weinstein's alleged badmouthing of Judd, which she claims significantly hurt her career. The judge said he wasn't determining whether Judd was sexually harassed by Weinstein "in the colloquial sense of the term".

Ms Judd was one of the first women to publicly accuse Weinstein of sexual misconduct.

The actress has accused the disgraced producer of sexual misconduct and maintains he worked to sabotage her career when she spurned his advances.Though the harassment portion of her case against the former movie mogul can not proceed, her allegations of defamation will be heard in court next year.

Ashley Judd was one of Mr Weinstein's original accusers.

Weinstein denied defaming Judd or interfering with her career.

Despite "serious discussions to play a major role in the Lord of the Rings trilogy", court documents state, Judd wasn't cast in the film.

In her lawsuit, filed last April, Ms Judd accused Mr Weinstein of smearing her reputation by discouraging director Peter Jackson from casting her in his movie franchise The Lord of the Rings.

"The burden on Weinstein has the potential of being dramatically and unfairly negative if the stay is denied".

Weinstein's attorney in this case, Phyllis Kupferstein said in a statement to CNN, "We have said from the beginning that this claim was unjustified, and we are pleased that the court saw it as we did".

"Nothing about today's ruling changes that Ms. Judd's case is moving forward on multiple claims", Theodore Boutrous Jr., the lead lawyer representing Judd's case, said in a statement reported by The New York Times Wednesday.

'We look forward to pursuing the three claims for relief that the court has already ruled can move forward'.

Judd appeared in "Frida", which was distributed by Weinstein's company Miramax in 2002, and starred in "Crossing Over", which was distributed by The Weinstein Company in 2009.

Weinstein is awaiting a pretrial hearing in March in a NY criminal case.

The disgraced Hollywood producer has been accused of sexual misconduct by more than 70 women. In October of 2017-just before the resurgence of the viral #MeToo movement-she recounted the accusations again, this time naming Harvey Weinstein as that mogul.
