Carlos Ghosn comes down with fever in jail, halting interrogation

Ghosn on Tuesday mounted a systematic denial of all the allegations, concluding that he had been "wrongly accused and unfairly detained based on meritless and unsubstantiated accusations".

Ghosn's lawyers had appealed to the court to free him, claiming at a special hearing in a Tokyo court there were no grounds for his detention, which has now lasted more than 50 days.

The second charge against him alleges that the under-reporting continued for another three years.

Even his main lawyer Motonari Otsuru has acknowledged the 64-year-old executive has little chance of being released soon, describing it as "very difficult" to win bail before the case goes to trial.

Ghosn; Greg Kelly, another Nissan executive; and Nissan as a legal entity also were charged Friday with additional underreporting of income, from 2015 through mid-2018.

He spoke in a strong voice and passionately declared a "genuine love and appreciation for Nissan", saying he had acted "honourably, legally and with the knowledge and approval of the appropriate executives inside the company".

"I believe strongly that in all of my efforts on behalf of the company, I have acted honorably, legally and with the knowledge and approval of the appropriate executives inside the company - with the sole objective of supporting and strengthening Nissan, and helping to restore its place as one of Japan's finest and most respected companies". "We are fearful and very anxious his recovery will be complicated while he continues to endure such harsh conditions and unfair treatment", she said.

"We took these steps today because we believed that they are cases worthy of indictment and going to trial", said deputy chief prosecutor Shin Kukimoto.

The maximum penalty for the falsifying financial reports and breach of trust is 15 years in prison, 10 million yen ($89,000) fine, or both. The judge, Yuichi Tada, said it was because he was considered a flight risk, and the possibility of concealing evidence. His current detention term is scheduled to end on Friday.

Mr Ghosn, whose detention has drawn some criticism, denies all wrongdoing.

French daily Le Figaro reported on Thursday that the board meeting was one of several informal gatherings held regularly since Ghosn's arrest to discuss developments in the case.

The jet-setting high-flyer who once sparked criticism for his lavish lifestyle has gone from spacious digs in worldwide capitals to a one-man cell.

What of the Alliance between Nissan, Mitsubishi, and Renault?

While the two Japanese firms quickly ousted him from leadership roles, Renault has kept him on and its board said on Thursday that an ongoing audit has found no sign of fraud in the last two years.

Nissan said Friday it has filed its own criminal complaint against its former chief "on the basis of Ghosn's misuse of a significant amount of the company's funds".
