Netflix Faces $25 Million Lawsuit Over ‘Black Mirror: Bandersnatch’

The popular on-demand video streaming service premiered Black Mirror: Bandersnatch in December previous year.

The ever-twisted, "Choose Your Own Adventure" movie Black Mirror: Bandersnatch has certainly been a hit for Netflix, but that doesn't mean everyone in the world is happy about the success.

"Chooseco and Netflix engaged in extensive negotiations that were ongoing for a number of years, but Netflix did not receive a license", the lawsuit reads.

Netflix has been sued for trademark infringement over its new interactive film Black Mirror: Bandersnatch, The Hollywood Reporter reports and Pitchfork can confirm.

According to a January 11th, 2019 Hollywood Reporter story, US -based publisher Chooseco filed documents in Vermont arguing that the publisher has used the phrase since the 1980s and has sold more than 265 million copies of its Choose Your Own Adventure books.

She also reiterated that Bandersnatch has nothing to do with the books, which were recently licensed by 20th Century Fox to develop an interactive film series. When Dad asserts that the book must not be very good, as Stefan is always "flicking backwards and forwards" through it, Stefan explains, "No, it's a choose your own adventure book".

If those words weren't capitalized, Netflix may have been able to get away with the idea of referring to the book as a type of story rather than a specific entry in the trademarked franchise - sort of like how some people refer to a generic tissue as a "Kleenex" just because that brand became synonymous with the item itself.

"The misappropriation of our mark by Netflix presents an extreme challenge for a small independent publisher like Chooseco", she said.

The bookmaker say Netflix doesn't have the right to that trademark. Chooseco is asking for $25 million in damages. "We would prefer not to resort to litigation, but given the damage that we will suffer as a result of the use of our mark we've been left with no other option". The franchise was extremely popular during the 1980s, growing to 184 books with more than 250 million copies printed.
