Supreme Court clears the way for new asylum restrictions to take effect

In a victory for President Donald Trump, the U.S. Supreme Court cleared the administration to enforce a new rule created to sharply limit who can apply for asylum at the U.S. -Mexico border.

The administration told the Supreme Court the rule "alleviates a crushing burden on the US asylum system by prioritizing asylum seekers who most need asylum in the United States".

The Supreme Court cleared the way for the Trump administration's rule that dramatically limits the ability of Central American migrants to claim asylum to go into effect nationwide while the appeals process plays out.

Justice Sonia Sotomayor, dissenting from the Supreme Court's decision, wrote that: "Once again the Executive Branch has issued a rule that seeks to upend longstanding practices regarding refugees who seek shelter from persecution".

The diversion of the Pentagon funds to border wall construction was justified under a controversial emergency declaration made by Trump after Congress repeatedly denied the president money for the project. Tigar issued a new order on Monday that reimposed a nationwide hold on asylum policy.

The 9th U.S. Circuit Court of Appeals had previously said the injunction could only reach as far as its jurisdiction, which includes nine states.

In July, Obama-appointed U.S. District Judge Jon Tigar in San Francisco blocked the White House ban.

Groups that assist asylum seekers filed a lawsuit and argued the policy was barred by federal law establishing how people can seek asylum.

"BIG United States Supreme Court WIN for the Border on Asylum!". Trump said on Twitter. The effect of that injunction was blunted by the 9th Circuit Court ruling restricting it to Arizona and California.

The court announced on Wednesday evening it would allow the enforcement of the new rules, pending government appeal of two decisions in the 9th Circuit Court.

The move overrides a blockage put in place by a district court in California, allowing the asylum crackdown to go into effect even while the lower court continues to hear broader arguments on the case.

The Trump administration has reason for optimism now that the case is back in the 9th Circuit.

The radical transformation of the court, which has 29 seats, is largely the result of Trump's push to nominate conservative judges and bypass traditional consultations with Senate Democrats.

"Thanks to Trump, the liberal 9th Circuit is no longer liberal", The Washington Post noted earlier this year.
