Did UK government mislead Queen Elizabeth II over parliament prorogation?

"So, if it were to be the case that the Government had misled the Queen about the reasons for suspending Parliament and the motives for it, that would be a very serious matter indeed".

But the UK Supreme Court could rule that their parliament was never prorogued and is still in session, meaning that there is no need to recall Parliament.

The First Minister spoke after three senior Scottish judges declared that Boris Johnson's decision to suspend Parliament was both "improper" and "unlawful".

This is different to "dissolving" Parliament - where all MPs give up their seats to campaign in a general election.

Downing Street said it was not under any obligation to bring parliament back into session following the Scottish ruling but added that the government would be bound by the judgment of the supreme court.

All three First Division judges have decided that the PM's advice to the HM the Queen is justiciable, that it was motivated by the improper objective of stymying Parliament and that it, and what has followed from it, is unlawful...

Normally courts do not intervene in the decisions of the government, using the principle of a "margin of appreciation", which gives ministers more leeway under the law than that of ordinary people or organisations.

The group of parliamentarians who petitioned the Court of Session said their understanding is parliament can now reassemble if it so wishes, with SNP MP Joanna Cherry among those calling for it to be recalled.

The Government immediately announced it was lodging an appeal against the ruling with the Supreme Court, with a hearing set for Tuesday.

However, prorogation has reduced the opportunities for MPs to scrutinise the Government - and has cut short the time remaining to debate Brexit in the Commons before October 31.

At Wednesday's hearing, Judge Lord Carloway told the court: "We are of the opinion that the advice given by the Government to Her Majesty the Queen to prorogue parliament was unlawful and that the prorogation itself was unlawful".

The contentious prorogation before October 14 took place in the wee hours of Tuesday after criticism from House of Commons speaker John Bercow, amongst others.

"The prime minister needs to heed this warning, get MPs back to Westminster and sort out the mess we're in".

Len McClusky, the leader of Unite, one of Britain's biggest trade unions, and one which gives financial support to Labour, has advised the United Kingdom prime minister not to visit Scotland as he may "face a citizen's arrest".

"It is quite extraordinary what the Scottish courts have ruled".

Manuel Cortes, head of the TSSA, called for Johnson to be arrested.

The Prime Minister's official spokesman rejected claims that the true objective was to prevent MPs thwarting his pledge to take Britain out of the European Union by October 31, with or without a deal with Brussels.

- What does it mean for the Brexit process? "I shouldn't have to say this to the prime minister - accept that parliament has spoken, accept you have no mandate for no deal, and be clear that you will follow the law", he said.
